The terms "we", "us" and "our" refer to Silvergrain Press Limited. We operate this website and online store.

Silvergrain Press operates this website and online store, including all related information, content, features, tools, products and services (together, the “Services”) to provide you with a curated shopping experience. Silvergrain Press is powered by Shopify, which enables us to provide the Services to you.

These Terms and Conditions (the “Terms”), together with any policies referenced here, describe your rights and responsibilities when you use the Services or place an order with us.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

These Terms do not affect any mandatory consumer rights that cannot be excluded under applicable law.

1. Access and account

By using the Services, you confirm that you are at least the age of majority where you live, or that you have the consent of a parent or legal guardian.

When using the Services or placing an order, you may be asked to provide information such as your email address, billing, payment, and shipping details. You agree that the information you provide is accurate, current, and complete, and that you are authorised to provide it.

You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.

2. Our products and colour representation

Our products are made to order. We make reasonable efforts to display products and materials accurately, but colours and appearance can vary depending on your device, display settings, lighting conditions, and the nature of printed output.

Please note that computer screens and mobile devices display images using RGB light, which is brighter and has a wider colour gamut than the physical inks (CMYK) used in printing. As a result, minor shifts in colour and a perceived reduction in brightness are normal when moving from a digital screen to a physical print and do not constitute a defect. 

Where products are created using files or images you provide, the final print will reflect the file you submit and approve, subject to normal print tolerances described in these Terms.

Product descriptions, availability, and specifications may change from time to time. If we make a change that materially affects an order you have already placed, we will contact you where required by law.

Nothing in this section limits your rights where goods must match their description and be of satisfactory quality under applicable consumer laws.

3. Orders, acceptance, and cancellations

When you place an order, you are making an offer to purchase. We may accept or decline an order for any reason, including for suspected fraud, payment issues, or operational constraints.

An order is not accepted until we confirm acceptance and payment is processed. Once accepted, production may begin shortly afterwards because our products are made to order.

Please review your order carefully before submitting. If you need to change or cancel an order, contact us as soon as possible at info@silvergrainpress.com. We will do our best to help, but we may be unable to change or cancel an order once production has started.

Your remedies for issues with an order, including print quality issues, damage in transit, or wrong item received, are set out in our Reprints and Refunds policy [LINK], which forms part of these Terms.

Purchases are intended for personal use. You may resell products directly to your own clients (e.g., as part of a photography service), but you may not resell our products on third-party marketplaces (such as Amazon, eBay, or Etsy) or export them in bulk without our prior written consent.

4. Prices, taxes, and billing

Prices, discounts, and promotions may change without notice. The price charged is the price shown at checkout at the time you place your order and will be confirmed in your order confirmation email.

Unless otherwise stated, prices may not include shipping, taxes, VAT, customs duties, or import charges. You are responsible for any customs duties, import taxes, or local charges assessed by your country or carrier.

You agree to provide current, complete, and accurate payment and account information, and to promptly update your information so we can complete your transaction and contact you if needed.

5. Shipping, delivery, and risk of loss

Delivery times are estimates and not guaranteed. Delays can occur due to carriers, customs processing, or events outside our control.

For customers in the United Kingdom and European Union, the risk of loss passes to you when the goods are delivered to you or to a person you authorise to receive them, in accordance with applicable consumer law.

For customers in the United States and Canada, risk of loss generally passes to you when the goods are delivered to the carrier, unless applicable law provides otherwise.

If your order arrives damaged, defective, or incorrect, please contact us in line with our Reprints and Refunds policy [LINK].

6. Made to order products and “cooling off” rights

Our products are made to order and often created using customer supplied content or specifications.

In some jurisdictions, consumers have a legal right to cancel certain online purchases within a cooling off period. Where local law provides such a right, that right may not apply to goods made to the customer’s specifications or clearly personalised.

This section does not limit any mandatory consumer rights that cannot be excluded under applicable law.

7. User supplied content, previews, and print responsibility

Some of our products allow you to upload images, text, or other content, or to design a layout using our tools.

You are responsible for ensuring that your content is accurate and appropriate, including resolution, cropping, spelling, and layout choices. Where we provide previews, you are responsible for reviewing them carefully before placing your order.

We are not responsible for issues that result from customer supplied content or choices, including: low resolution source files, unintended cropping selected by you, spelling or text errors in your content, or design decisions made by you in the builder.

We may apply technical adjustments needed for production, provided these do not materially change the nature of the product.

Your content and permissions

You retain ownership of any images, text, or other content you upload or submit through the Services (“User Content”).

By uploading or submitting User Content, you grant Silvergrain Press a limited, non exclusive, worldwide licence to use, reproduce, process, and display that User Content only as needed to provide the Services and fulfil your order, including producing, printing, packaging, and shipping your products, and providing customer support.

You confirm that you own or have the necessary rights, permissions, and consents to upload and use the User Content and that it does not infringe the rights of any third party.

We reserve the right to refuse or cancel orders containing content that, in our sole discretion, we deem to be unlawful, infringing, obscene, pornographic, hateful, or otherwise objectionable, regardless of whether such content is prohibited by law.

8. Intellectual property

The Services, including trademarks, branding, text, displays, images, graphics, videos, and the design and arrangement of the Services, are owned by Silvergrain Press or its licensors and are protected by intellectual property laws.

You may use the Services for your personal, non commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent, except as permitted by law.

Silvergrain Press names, logos, product and service names, designs, and slogans are trademarks of Silvergrain Press. Shopify’s name, logo, and related marks are trademarks of Shopify. All other marks are the property of their respective owners.

9. Optional tools

We may provide access to tools or features offered by third parties. We do not control these third party tools and provide them on an “as is” and “as available” basis. Your use of any third party tools is at your own risk and subject to the third party’s terms.

10. Third party links

The Services may include links to third party websites or services. We are not responsible for third party content, policies, or practices. If you access third party sites, you do so at your own risk.

11. Relationship with Shopify

Silvergrain Press is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Silvergrain Press.

You acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Silvergrain Press, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Silvergrain Press.

12. Privacy

All personal information we collect through the Services is subject to our Privacy Policy [LINK]. Because the Services are hosted by Shopify, Shopify also collects and processes information about your access to and use of the Services to provide and improve Shopify’s services. Please see Shopify’s privacy policy for more information.

13. Feedback and reviews

If you submit reviews, feedback, suggestions, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty free, sublicensable licence to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including to operate, improve, and promote the Services.

You confirm that you own or have the necessary rights to provide Feedback and that your Feedback does not infringe the rights of others.

14. Errors, inaccuracies, and omissions

Occasionally, information on the Services may contain errors or inaccuracies relating to descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct these and may cancel or refuse orders where permitted by law.

If we cancel an order after payment has been taken, we will issue a refund.

15. Prohibited uses

You may use the Services only for lawful purposes. You must not use the Services to violate any laws, infringe intellectual property rights, harass others, transmit malware, scrape the site, interfere with security features, or engage in conduct that restricts others’ use or enjoyment of the Services.

We may suspend or terminate access to the Services if we believe you have violated these Terms.

16. Termination

We may terminate or suspend your access to the Services at any time if we believe you have violated these Terms. You remain liable for amounts due up to the date of termination.

Sections that by their nature should survive termination will survive, including intellectual property, feedback, disclaimers, limitation of liability, indemnity, and governing law.

17. Disclaimer of warranties

We provide the Services and all content on the Services for general information purposes. To the fullest extent permitted by law, the Services are provided “as is” and “as available”.

This does not affect any warranties or guarantees that cannot be excluded under applicable consumer law, including statutory rights relating to the quality of goods and services.

18. Limitation of liability

To the fullest extent permitted by law, Silvergrain Press will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, savings, data, or goodwill, arising from your use of the Services or purchase of products.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded.

Where liability cannot be excluded but can be limited, our liability will be limited to the amount paid for the relevant order, to the extent permitted by law.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Silvergrain Press and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of law, or your misuse of the Services.

This indemnity does not apply to consumers where prohibited by applicable law.

20. Severability

If any provision of these Terms is held unlawful or unenforceable, the remainder will remain in effect.

21. Entire agreement

These Terms and the policies referenced in them constitute the entire agreement between you and us regarding the Services and supersede prior communications or agreements relating to the Services.

22. Assignment

You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganisation, or sale of assets, or as otherwise permitted by law.

23. Governing law and disputes

If you are a consumer, you may have the benefit of mandatory consumer protection laws in your country of residence, and nothing in these Terms affects those rights.

These Terms are governed by the laws of England and Wales if Silvergrain Press is based in the United Kingdom, or by the laws of the jurisdiction where Silvergrain Press is established if stated otherwise in our store information. In all cases, the governing law clause applies only to the extent permitted by law, and does not deprive consumers of mandatory protections in their home jurisdiction.

Courts with jurisdiction will depend on applicable law and consumer rights.

24. Changes to these Terms

We may update these Terms from time to time by posting a new version on this page. If required by law, we will notify you of material changes. By continuing to use the Services after changes take effect, you agree to the updated Terms.
